SC Justice Castillo lectures Lagman after insisting that Marawi Crisis cannot be considered as ‘rebellion'



Supreme Court Justice Mariano del Castillo told Albay First District Representative Edcel Lagman that the situation in Marawi City can be considered as act of rebellion.

"They're precisely putting up their flag there to supplant the authority of the local government of their own, in effect they're trying to remove the allegiance of Marawi City from the government," Del Castillo told Albay First District Representative Edcel Lagman, who argued for the minority lawmakers group of petitioners.
But Lagman stuck to his old argument and said the raising of an ISIS flag is the terror groups' longtime resort to "cheap propaganda."

He slammed President Rodrigo Duterte’s report to congress, which Lagman labeled as full of lies and falsities.

Lagman stressed that President Duterte didn’t consulted the defense secretary or the generals before declaring martial law.

“It stands to reason that when the President exercises a very serious, extraordinary power, he must be supported by the necessary coordination, recommendation, and consultation from the ranking officials of the defense and military sectors,” Lagman said.

He also said that the video of Isnilon Hapilon planning to takeover of Marawi City that convinced the senators to support the martial law declaration was recovered two days after martial law was declared so it’s not the basis of President Duterte to declare martial law.

Justice del Castillo asked Lagman if the lawmaker already visited Marawi City since the crisis erupted to which Lagman answered no.

del Castillo said that petitioners cannot say martial law in Mindanao if they didn’t personally visited Marawi City and experienced the real situation in the place.

“So it would be too difficult to say that the situation there does not amount to rebellion. You’ve not been there, you’re not on the ground, you don’t know the situation there. How can you dispute now the findings of sufficiency of factual bases for the declaration?” del Castillo said.

The SC Justice said that many soldiers already died and people already evacuated in their homes because of the war in Marawi City and he asked Lagman why he’s so worried about the martial law in Mindanao.

“The military casualty count as of last Sunday is already 58 soldiers, Congressman, dead soldiers of ours. And there are 25,000 evacuees now in Iligan City. So for you the situation is still not that serious for Martial Law to … I mean, Martial Law will only be with us for 60 days, assuming that he [Duterte] won’t lift the proclamation earlier. With all the safeguards, I don’t know why you are so worried.” del Castillo told Lagman.

  2. mr. lagman you better shut up. Mr. President Duterte is a good President. He knows the situations in Mindanao. if I were you, accept the reality that President Duterte is our 1st Mindanao President who looked for the welfare of his people. Many Presidents were elected coming from Luzon & Visayas the problems were the same corruption, insurgency, drugs and etc. not one even try to run after/solved these problems in the society.now, all bad elements are been solved naa pod ka nagsigi yawyaw against him. maau pa ug ming adto ka sa lugar nga nagkasamok ky aron sab ninyo/nimo pakita why need for declaration of martial law. do not blame our president do not say something against Mr. Duterte 'coz he's the only man one who give more time in solving the problems in the nation especially in Mindanao.

Lagman is looking for what we call a change of law, he wants the lawless group like maute a terrorist and not a rebel group, let us say he is correct in terms of presumption, the group raising flag of terrorists gives an implication that a flag is a creation to topple the government of marawi so it means that is an element of rebellion per se. It is a dispute to know what is really a rebellion in marawi and what is terrorism is exist? here I can say both are existed, they are terrorist group and at the same time doing the act of rebellion by putting flags in different area in marawi city. They enter the area and stay there and tried to remove the military and the police and scared the citizens and decided to leave their homes. Now How we call it? Is it an act of terrorsim or an act of rebellion?...

  8. I am from Albay, walang nagawa yang si Lagman sa probinsya namin. Sa kinatagal tagal nya sa Albay walang asenso ang Albay dahil sa corrupt na politiko katulad ni Lagman. Bata pa lng ako congressman na yang buwaya na yan.
